Welcome to rarara.sh. By accessing or using our file upload services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these Terms, please do not use our Service.

We are a file upload platform that allows users to upload, share, and download files. We are hosted by vsys.host, a Ukrainian hosting provider. Please read their Terms of Service for more details.

2. Use of the Service

You agree to use the Service only for lawful purposes. You may not use the Service to upload, distribute, or share any content that:

• Violates any applicable local, state, or national law, including but not limited to intellectual property laws and data protection laws.
• Contains or distributes malicious software, viruses, or any harmful code.
• Infringes upon the copyright, trademark, privacy, or any other rights of third parties.
• Promotes or engages in illegal activities, including but not limited to the distribution of illegal, harmful, or abusive content.

We reserve the right to remove any content that violates these Terms and to suspend or terminate your account.

3. User Responsibilities

You are solely responsible for the files you upload, share, or distribute through our Service. You must ensure that:

• You have all necessary rights and permissions to upload and share the files.
• Your use of the Service does not violate any third-party rights or laws.
• You comply with all applicable laws, including copyright laws and data protection regulations, in your jurisdiction.

By using our Service, you acknowledge that we do not actively monitor or control the files uploaded to our platform, but we may review and remove content in accordance with our policy or legal obligations.

4. Content Ownership and License

You retain ownership of all files you upload to our Service. However, by uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and distribute the content to the extent necessary to provide the Service.

You also agree that we may use automated systems to scan and analyze uploaded files for harmful or illegal content. We will not share your files with third parties unless required to do so by law or if you explicitly request us to share your content with others.

5. File Deletion and Cleanup

We provide a file auto-deletion service to ensure the integrity and security of our platform. All uploaded files will be automatically deleted 15 minutes after being uploaded. This is done through a script called cleanup.php that handles file cleanup.

By using our Service, you acknowledge that:

• All files uploaded to the platform are automatically deleted after 15 minutes.
• We cannot retrieve files after they have been deleted by the cleanup process.
• If you need to keep a file for longer than 15 minutes, you are responsible for downloading it before the deletion occurs.

6. Prohibited Content

You may not use the Service to upload, store, or share any of the following types of content:

• Content that violates the intellectual property rights of others, including pirated software, copyrighted material without permission, and other unauthorized content.
• Pornographic or obscene content.
• Content that promotes terrorism, violence, or illegal activities.
• Content that violates the privacy rights of others, including the unauthorized sharing of personal data.

We reserve the right to remove any files that violate these Terms and to take necessary action, including account suspension or termination.

7. Termination and Suspension of Accounts

We reserve the right to suspend or terminate your access to the Service if you violate these Terms, engage in illegal activities, or if we determine, at our sole discretion, that your use of the Service is harmful to our platform or other users.

If your account is suspended or terminated, you may lose access to your files, and we will not be liable for any loss of data.

8. Disclaimer of Warranties

Our Service is provided "as is" without any warranties, express or implied. We do not guarantee that the Service will be error-free, secure, or uninterrupted. We are not responsible for any errors, omissions, or interruptions in the Service.

We are not liable for any damages or losses arising from your use of the Service, including but not limited to loss of data, files, or content.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim related to the Service shall be limited to the amount you have paid for the Service in the 12 months prior to the claim, if applicable.

10. Data Privacy and Security

We take reasonable precautions to protect your data and files. However, as a file-sharing service, we cannot guarantee absolute security. You are responsible for ensuring that the content you upload does not violate the privacy rights of others.

You agree to comply with applicable data protection laws and regulations in your jurisdiction when uploading or sharing files.

11. DMCA Takedown Policy

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been uploaded to our Service without authorization, you may file a takedown request by contacting us at [your DMCA contact email]. 12. Changes to the Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and indicating the date of the last update. Your continued use of the Service after any changes to these Terms will constitute your acceptance of those changes.

These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising from these Terms shall be resolved in the competent courts of Ukraine.
